Providing legal support to those considering dissolving a marriage in North Carolina

People enter long-term relationships with the best intentions and the highest expectations. But unfortunately, even the best-laid plans may not play out the way we hoped or expected. When it comes time for a married couple to go their separate ways, Devan & Null PLLC in Fayetteville is there to help the process go smoothly and fairly. With nearly a half-century of combined experience, our divorce attorneys help prepare you and advocate for you every step of the way.

Skilled assistance with filing for divorce in North Carolina

In order to file for divorce in North Carolina, at least one of the spouses must have resided in the state for at least six months. Spouses must also live separate and apart for at least one year with at least one of them having the intent to end the marriage.  These issues can become particularly complex for military families due to deployments and change of duty stations. Our firm has years of experience in dealing with the military divorce.

What to expect when facing divorce in Fayetteville

Every divorce is different, but there are several issues that commonly arise. Our Fayetteville family law  attorneys can help you face each of these issues with full confidence:

  • Grounds — North Carolina is a no-fault divorce state.  The legal ground for a separation is a one year separation wtih the intent to end the marital relationship by at least one of the spouses. Separation agreements can help define this period as couples prepare to ultimately obtain their divorce in North Carolina. Separation by itself is not the same as divorce. Even couples who have been living separate and apart for more than one year must go through the divorce process to dissolve their marriage legally.
  • Property division — Property earned by either spouse during the course of a marriage is subject to distribution by the court. While courts typically distribute marital property equally, the law does allow each spouse to receive unequal amounts when equal distribution would not be equitable. This may occur under a variety of circumstances, such as if the spouses have significantly unequal earning power, if one of the spouses wasted marital assets, or if one of the spouses is taking primary custody of children. Because of the complexity of this issue, collaborative divorce is often a great option for resolving complex property division problems amicably.
  • Alimony and support — Courts regularly order post-separation support based on the relative incomes of the spouses to ease the process for the economically disadvantaged spouse. Longer-term alimony, however, may be appropriate under certain circumstances, such as particularly lengthy marriages.
  • Child custody — In any marriage with children, child custody is a significant issue. Custody may be shared jointly — split between both parents — or awarded to one parent, with the other having visitation rights. It is often the most contentious issue during divorce and, as such, mediation can be a helpful means of working out all the details.

No two divorces are the same. They can range from relatively simple and amicable to bitter and complex. At Devan & Null, we have seen all types of divorce cases and know how to handle them. We recognize the special needs of each client and guide every client to the best resolution available.

Absolutely outstanding lawyers! They have a combined nearly 50 years in legal experience, both on the bench and in front of it. I cannot give a higher recommendation! Both are high character and hard workers. You cannot go wrong with this firm!

Laura is an absolute dream. She took on my case only two weeks before my hearing and she was amazing. She worked hard to get up to speed on what was going on, was very calm and professional in court and made me feel confident in what was to come. I absolutely recommend her.
